In Episode 254 of the CounterVortex podcast, Bill Weinberg continues to make the case for mass pressure to demand nullification of the election—on the constitutional basis of the Insurrection Clause. Trump indisputably instigated an insurrection on Jan. 6, 2021, and the Supreme Court has ruled that invoking the Insurrection Clause to bar him from the presidency is the prerogative of Congress. And the Electoral College has the power to refuse to seat him on the same grounds. A candidate for county commissioner in New Mexico has already been barred from office on the basis of having participated in the Capitol insurrection—and MAGA congressional candidate Madison Cawthorn could also have been barred on that basis if he hadn’t been primaried out as the case over the matter was still pending before the courts. Leading Democrats like Rep. Jamie Raskin have spoken in support of such disqualifications—yet are mysteriously silent with the country now on the countdown to a fascist takeover. Furthermore, some cybersecurity experts are calling for a forensic audit of the election, citing evidence of software breaches and other irregularities. In Romania, where a Putin-favored right-wing populist has won the first-round vote in the presidential election, a recount has been ordered by the courts in response to a public outcry. And protests continue to mount in the Republic of Georgia, following a contested election in which a Putin-favored right-wing populist party cemented its majority. As the Trump team’s plans fall into place for mass detention of millions of undocumented immigrants—perhaps even naturalized citizens—and establishment of a concentration camp system, invocation of the Insurrection Act to mobilize the army for the round-ups has been broached. Sending National Guard troops from red states into blue states to carry out round-ups and put down protests—over the objections of governors who have refused to cooperate—could portend civil war. There is still time to invoke the 14th Amendment to bar Trump from the presidency—just as Brazil’s Jair Bolsonaro, indicted for leading a Trump-style attempted auto-golpe in 2022, has been barred from office. Podcast: nullify the election!

As Trump assembles his cabinet of dangerous cranks and far-right extremists, his election is being openly celebrated by reigning fascists and arch-reactionaries from Russia to Hungaryto Bosnia. The fascist world order that began to consolidate under his first term is poised to be cemented under a global triumvirate of tyranny—Trump, Putin and Xi. Biden’s cooperationin the transfer of power is a betrayal not only of the nation but of humanity—and Trump has still failed to sign the ethics pledge mandated by the protocol of presidential transition, making clear his ill intent. Evidence that the Kremlin directly hacked the vote on behalf of Trump (rather than merely using disinformation propaganda, as in 2016) warrants investigation. Furthermore, the Insurrection Clause of the 14th Amendment, under which Trump was impeached, should be invoked to bar him from office. There is still time to stop the fascist takeover of the United States through the Electoral College or in the certification process. Despite the Supreme Court decision upholding state laws against “faithless electors” who refuse to vote for the candidate they pledged for, this is by no means equivalent to the “fake electors” contrived by Trump’s team to try to throw the 2020 election. On the contrary, it is a constitutional mechanism, as outlined by Hamilton in the Federalist Papers. Mandate for fascism, strategy for resistance

Donald Trump has for the first time won the popular vote, and now around an openly fascist program, starting with plans for mass detention of millions of undocumented immigrants. While there are signs of an emergent resistance, there are also undeniable signs of a left-MAGA convergence around a mutual embrace of authoritarian populism, exploiting disaffection from Biden-Harris’ criminal support for Israel’s genocide in Gaza. In Episode 251of the CounterVortex podcast, Bill Weinberg stakes stock of this grim juncture for the United States and the world. We also revive our call from 2016 for electoral nullification—the electors refusing to seat Trump. The New York judge in Trump’s “hush money” case must immediately impose the maximum sentence of four years in prison, bringing on the needed constitutional crisis, and the Electoral College must do what it was designed to do under the Constitution: bar a dangerous demagogue from the presidency. Vote for ‘Killer Kamala.’ It’s important.

With UN aid agencies and humanitarian organizations warning of an “apocalyptic” scenario in North Gaza, the Biden administration faces a lawsuit charging complicity with genocide. The “pause” that the White House has imposed on some arms shipments to Israel by no means absolves the administration of moral (or legal) culpability. However, it may have had the effect of restraining Benjamin Netanyahu’s maximalist plans to cleanse the Gaza Strip of Palestinians altogether. President Trump meanwhile recognized Israeli annexation of the Golan Heights, recognized Jerusalem as the capital of Israel, and launched the “Abraham Accords“—predicated on betrayal of the Palestinians by the Arab leadership. His 2019 executive order officially embraced the propagandistic conflation of anti-Zionism and anti-Semitism, and he now calls for complete repression (including by the military) of Palestine solidarity protests. Jared Kushner, Trump’s son-in-law who was his Middle East pointman, is now openly backing the cleansing of Gaza of all Palestinians, while his ultra-Zionist former ambassador to Israel, David Friedman, is an open advocate of Israeli annexation of the West Bank and destruction of al-Aqsa Mosque. As Trump accuses Biden of “holding back” Israel, it is clear that Netanyahu and his most hardline cabinet members like Itamar Ben-Gvirare openly rooting for him—as is the Israel Lobby in DC. Podcast: Tolstoy would shit II

The bellicose and authoritarian Russian state’s propaganda exploitation of the anarcho-pacifist novelist Leo Tolstoy is an obvious and perverse irony. But a less obvious irony also presents itself. Like all fascist regimes, that of Vladimir Putin is stigmatizing and even criminalizing homosexuality and other sexual “deviance.” Following alarming reports of “concentration camps” for gay men in the Russian republic of Chechnya, Moscow began to impose an anti-gay agenda nationwide. A 2020 constitutional reform officially enshrined “traditional marriage,” while a “gay propaganda law” imposes penalties on any outward expression of gay identity, resulting in police raids on Moscow gay bars. The “LGBT movement” has been designated a “terrorist organization”; media depictions of same-sex love are banned as “deviant content.” Yet the venerable littĂ©rateur now glorified as a symbol of Russian nationalism may have himself been gay. Once-time peacenik icon Tulsi Gabbard has joined Robert F. Kennedy Jr in defecting to the now openly fascist and even Nazi-embracing MAGA camp—actually becoming members of the Trump transition team. Meanwhile, the Green Party presidential candidate Jill Stein, likewise enamoured of Vladimir Putin and the dictators in his orbit (including mass murderer Bashar Assad), is being represented by a former Trump attorney in her bid to get on the ballot in swing state Nevada. Beyond the threat that she could serve as a spoiler and throw the election to Trump, this raises questions about the cooptation of segments of the American left by MAGA-fascism. It is no longer just the old-school sectarian “tankie” left that’s in danger of taking the fascist lure in a Red-Brown alliance, but the pacifist, cannabis-friendly “green” left as well. Russian fascism: enemy of Black liberation

Four Black nationalists affiliated with the Uhuru Movement, an arm of the African People’s Socialist Party (APSP), are on trial for acting as agents of a Russian propaganda network, in what they are calling “the free speech trial of the century.” Regardless of whether their activities were protected by the First Amendment, the case reveals the very strangest of political bedfelows. Tucker Carlson, who similarly serves as a conduit for Russian propaganda, is also mentioned (although not charged) in a new federal indictment. Carlson is scheduled to appear onstage with JD Vance later this month, and recently hosted an uncloseted Nazi-nostalgist on his Twitter program. The absurd irony of the APSP platforming Kremlin demonization of Ukraine as a “Nazi” state is heightened by Russia’s serial massacres of Black Africans in its new military adventures on the continent. The Anti-Globalization Movement of Russia, which seemingly cultivated Uhuru/APSP, is similarly cultivating white supremacists, who are overtly Trump-aligned and marched at the Charlottesville hate-fest in 2017. The ultimate stateside beneficiary of this Kremlin-orchestrated propaganda effort is of course Donald Trump—who as president in 2020 sought to unleash the military against that year’s Black Lives Matter uprising. Yet while too many “radicals” take the Kremlin bait, once-reviled “liberals” like the National Urban League actually take a more progressive position on Russia and Ukraine.
