Lawyers for former Guantánamo Bay detainee Ahmed Ghailani argued Jan. 11 that the charges against their client should be dismissed. Ghailani’s lawyers argued before Judge Louis Kaplan of the US District Court for the Southern District of New York that he was denied the right to a speedy trial while being detained for nearly five years in Central Intelligence Agency (CIA) secret prisons and later at Guantánamo Bay. US judge refuses to drop charges against ex-Gitmo detainee
A federal judge on May 11 refused to dismiss criminal charges against former Gitmo detainee Ahmed Ghailani, despite his lawyers claims that he had been tortured in prison. Judge Lewis Kaplan of the US District Court for the Southern District of New York said that even if Ghailani was mistreated while in CIA custody, there was no connection between that and the current prosecution. Kaplan made no finding on whether Ghailani was subjected to torture. Kaplan has yet to rule on a motion to dismiss charges because of a violation of Ghailani’s speedy trial rights. (Jurist, May 11)
