										<content:encoded><![CDATA[<p><a href="http://www.hrw.org/">Human Rights Watch</a>&nbsp;(HRW) on Jan. 25&nbsp;<a href="https://www.hrw.org/news/2018/01/25/libya-deadly-mosque-attack-violation-laws-war">condemned</a>&nbsp;the deadly mosque attack in eastern Benghazi two days earlier&nbsp;that left 34 people dead and 90 wounded, the majority civilians including three young children. According to a local hospital source, the car bombs exploded within 15&nbsp;to&nbsp;30 minutes of each other in front of the Baya&#39;at al-Radwan Mosque in the Salmani district of Benghazi. The identity of the individuals or group that set the bombs is currently unknown. The first explosion occurred as worshipers were on their way out, after finishing their evening prayers known as <em>&quot;al-Isha,&quot;</em> killing three and injuring six. The second explosion, which caused the majority of the casualties, followed the arrival of security forces and volunteer civilians who were helping to evacuate the wounded and dead.</p>

<p>HRW warns that &quot;The laws of war strictly prohibit attacks that target civilians or civilian structures, including mosques&#8230; indiscriminate attacks, which fail to distinguish between military and civilian targets, and disproportionate attacks, in which the civilian casualties or damage to civilian buildings is excessive considering the military advantage gained.&quot;</p>
<p>HRW senior researcher Hanan Salah called for the Libya government to conduct a transparent and effective investigation of the incident: &quot;Planting bombs outside a civilian mosque, in particular when the timing is likely to inflict maximum casualties among civilians, is a war crime&#8230; Civilians in Benghazi are unacceptably bearing the brunt of this conflict&#8230; Authorities in eastern Libya should conduct a transparent and effective investigation into the incidents, and to the extent possible, prosecute those found to be responsible for criminal attacks.&quot;</p>

										<content:encoded><![CDATA[<p>In a victory for Berber activists, Algeria officially celebrated&nbsp;Yennayer, the new year holiday of the Amazigh people, for the first time. President Abdelaziz Bouteflika said declaration of Yennayer as a national holiday was officially approved at a meeting of his Council of Ministers. Yennayer marks the first day of the agrarian calendar, celebrated by the Berber (Amazigh) people across North Africa on Jan. 12. This&nbsp;Yennayer marks the first day of the year 2968 in the Amazigh calendar, which starts counting from the enthronement of&nbsp;Shoshenq I in Egypt, initiating a Berber-ruled dynasty. The move to recognize Yennayer&nbsp;is part of a general effort by Algeria&#39;s government to permit greater expression of Amazigh culture in order to head off a separatist movement, marked by the recent proclamation of a <a href="https://www.kabylie-gouv.org">Provisional Government of Kabylia</a> in the country&#39;s Berber-majority eastern region.</p>

<p>But recognition of Yennayer was still controversial among Arab nationalists, who dismiss it as an &quot;invented tradition.&quot; The debate extends to theories about the origins of&nbsp;word Yennayer, with some scholars claiming it&nbsp;derives from the Latin Ianuarius (January). Berbers hold that it derives form the words&nbsp;<em>yen</em> (one) and <em>ayer</em> (month) in their language, known as Tamazight.</p>
<p>Bouteflika&#39;s announcement of the&nbsp;Yennayer celebrations closely followed&nbsp;Berber protests in December, calling for&nbsp;the government to assign state funds for the protection and recovery of&nbsp;the&nbsp;Tamazight&nbsp;language. <p>Morocco, which has generally had more tolerant position toward Berber culture, still has no official Yennayer celebrations, and Amazigh leaders there, inspired by the developments in neighboring Algeria, are now pressing for recognition of the holiday. In late December, several Amazigh organizations signed a statement addressed to&nbsp;Prime Minister Saad Eddine el-Othmani, urging him to declare the day a national holiday in Morocco.&nbsp;</p>

										<content:encoded><![CDATA[<p>A jury in Washington&nbsp;DC &nbsp;on Nov. 28&nbsp;acquitted the accused ringleader of the 2012 Benghazi attacks&nbsp;of murder but <a href="https://www.justice.gov/usao-dc/pr/ahmed-abu-khatallah-found-guilty-terrorism-charges-september-2012-attack-benghazi-libya">convicted</a> him on terrorism charges. After five days of deliberations, the jury found <a href="/node/13339">Ahmed Abu Khatallah</a> guilty of one count of conspiracy to provide material support or resources to terrorists, one count of providing material support or resources to terrorists, one count of placing lives in jeopardy within the special maritime and territorial jurisdiction of the United States, and one count of using and carrying a semiautomatic weapon during a crime of violence. He was acquitted of the remaining counts against him.</p>

<p>On the night of the 2012 attack, Khatallah apparently ordered his men to carry out the attack by first striking the US Special Mission in Benghazi. The men, armed with AK-47s, grenades&nbsp;and other weapons, invaded the building. US Ambassador Christopher&nbsp;Stevens and government employee Sean Smith died of smoke inhalation. A second attack at a CIA annex resulted in the deaths of Tyrone Woods and Glen Doherty. According to government evidence, Khatallah maintained contact with his group before, during and after the attack.</p>
<p>Khatallah faces statutory maximums of 15 years in prison on each of the two terrorism offenses, 20 years for&nbsp;territorial jurisdiction violations,&nbsp;and life imprisonment for the firearms offense.&nbsp;A sentencing date has not yet been set.</p>

										<content:encoded><![CDATA[<p>Forces loyal to the Libyan National Army (LNA), military arm of the country&#39;s&nbsp;unrecognized <a href="/node/15628">eastern government</a>, appear to have executed captured fighters in Benghazi and desecrated corpses, Human Rights Watch charges. Video recordings posted online since January seem to show LNA fighters carrying out seven distinct unlawful executions of &quot;extremists.&quot; The most recent video, which appeared on social media July 24, shows the apparent summary execution of 20 blindfolded men with their hands tied behind their backs in orange jumpsuits, whom the commander in charge accuses of &quot;terrorism.&quot; The executioners appear to be members of a special forces unit headed by Mahmoud al-Werfalli.</p>

<p>The Army Special Forces in Benghazi, under the command of Wanis Bukhamada, are linked to the LNA, which is commanded by Gen. <a href="/node/15628">Khalifa Hiftar</a>. The LNA is allied with the Interim Government, one of the three governments vying for legitimacy, international recognition, and control of territory in Libya.</p>
<p>On August 15, the International Criminal Court (<a href="https://www.icc-cpi.int/">ICC</a>) issued an <a href="https://www.icc-cpi.int/Pages/item.aspx?name=pr1328">arrest warrant</a> for al-Werfalli for the war crime of murder. He is wanted by the court for his alleged role in the killing of 33 people in seven incidents that took place in and around Benghazi between June 2016 and July 2017. The Interim Government should take immediate steps to facilitate the surrender of al-Werfalli to the ICC, Human Rights Watch said.</p>

										<content:encoded><![CDATA[<p>Possibly as many as 130 soldiers of the <a href="/node/15407">Libyan National Army</a>, loyal to the eastern commander&nbsp;<a href="/node/15493">Khalifa Haftar</a>,&nbsp;are reported to have been summarily executed&nbsp;after a mixed force loyal to the Tripoli-based &quot;official&quot; <a href="/node/15493">Government of National Accord</a> took&nbsp;the Brak al-Shatti airbase in the country&#39;s south May 18.&nbsp;The attacking &nbsp;troops were&nbsp;members of the Third Force militia from&nbsp;Misrata the <a href="/node/15368">Benghazi Defense Brigades</a>.&nbsp;The mayor of Brak al-Shatti reported that most of the defenders were killed with a shot to the head, but five beheaded. &quot;They killed everyone at the base: soldiers, cooks, cleaners,&quot;&nbsp;said one LNA source.</p>

<p>The GNA&#39;s Presidency Council&nbsp;insisted it had nothing to do with the massacre&mdash;despite the fact that the Third Force militia had recently been intergated into the&nbsp;13th Battalion of Libyan Army, under direct command of the GNA&#39;s Defense Ministry. <p>The leaders of the two major factions in Libya&#39;s&nbsp;civil war&mdash;<a href="/node/14970">Fayez al-Sarraj</a>, head of the Tripoli-based &quot;<a href="/node/15407">official</a>&quot; government, and the eastern warlord <a href="/node/15407">Khalifa Haftar</a>&mdash;reportedly agreed to hold new elections after meeting in the UAE last week. The&nbsp;elections, aimed at finally unifying the country, are said to be tentatively scheduled&nbsp;for&nbsp;March 2018. <p><a href="/node/13331">Women&#39;s&nbsp;rights activists</a> have angrily taken to Twitter and other social media after the CDA apparently&nbsp;backtracked on a major issue. While a previous draft of the new constitution had allowed women to pass on their nationality to their children, the latest version has removed that provision, sparking online&nbsp;outrage. <p>An April 30&nbsp;meeting by CDA members with&nbsp;the Libyan Amazigh High Council (LAHC)&nbsp;in the western town of Zuwara was especially conentious. The CDA is trying to convince leaders of the&nbsp;Amazigh&nbsp;(Berber) people to join the drafting process, which they are now <a href="/node/12529">boycotting</a>, accusing the body of having an undemocratic structure.&nbsp;The LAHC has urged Libyans not to recognize any draft devised by the CDA. <p>The LAHC&nbsp;has issued its own statement&nbsp;declaring&nbsp;the language of the Amazigh people, Tamazight, as an &quot;<a href="/node/10374">official language</a>&quot; in the cities and districts inhabited by the Amazigh in Libya. &quot;This legal status that was given to the Amazigh language is the first step that will preserve the Berber identity and culture without awaiting the actions of the state institutions, which are undergoing political upheaval and legal deterioration,&quot;&nbsp;the statement said.</p>
<p>LAHC member&nbsp;Siham Bentaleb added that the Amazigh language will be studied in public schools, and used in official documents and on road signs. &quot;We will keep on pushing until we get the language the legal status it deserves by the new Libyan constitution,&quot; she pledged, while disavowing any separatist aspirations. Others strenuously reject this as a step toward the country&#39;s <a href="/node/12665">balkanization</a>. 										<content:encoded><![CDATA[<p>Human Rights Watch&nbsp;said March 21 that members of the Libyan National Army (LNA) <a href="https://www.hrw.org/news/2017/03/22/libya-war-crimes-benghazi-residents-flee">may have committed war crimes</a>&nbsp;in Benghazi on and around March 18. Benghazi has been center of stand-off between the LNA and the Benghazi Revolutionaries Shura Council (BRSC) for almost two years. On March 18, dozens of civilians attempted to flee the Ganfouda neighborhood of the city. Some of the civilians were accompanied by BRSC soldiers. Relatives of some of the civilians who fled stated that LNA fighters intercepted roughly seven fleeing families, attacking and killing some of them and detaining others. There have also been photos and videos of LNA fighters mutilating and desecrating the corpses of BRSC fighters. LNA leadership has made statements denouncing the actions of those fighters, and pledging to arrest those who have committed the violations. The LNA has also justified some other actions believed to be war crimes. This includes a video of an LNA captain shooting three restrained men in the back with a machine gun as they kneeled facing a wall.&nbsp;An LNA special forces spokesman defended the incident as having occurred &quot;within the battlefields.&quot;</p>
